The City of Perth, along with all local governments, prepares local planning schemes to control and guide land use and development.


Local Planning Schemes

Local planning schemes include provisions relating to a range of matters such as the use of land, the intensity and design of development, as well as the preservation and conservation of places and areas.

The City bases planning decisions on the provisions and controls within its local planning schemes, along with related plans and policies.

The Planning and Development (Local Planning Schemes) Regulations 2015

The Planning and Development (Local Planning Schemes) Regulations 2015 (the Regulations) were gazetted on 25 August 2015 and took effect on 19 October 2015, replacing the Town Planning Regulations 1967.

The Regulations introduce a set of deemed provisions that automatically apply to every operational local planning scheme in Western Australia, including the City Planning Scheme No. 2 (CPS2).

The deemed provisions supersede the current provisions of CPS2 with respect to:

The requirement for Development Approval;

  • Applications for Development Approval;
  • New Application Forms;
  • The procedure for dealing with applications for Development Approval;
  • A number of definitions;
  • Heritage protection;
  • The process for the preparation and adoption of a local planning policy;
  • Enforcement and Administration; and
  • Delegations.

CPS2 therefore needs to be read in conjunction with the deemed provisions of the Regulations.

The deemed provisions cannot be varied, however there is provision in the Planning and Development Act 2005 (the Act) to add supplemental provisions that may expand on the deemed provisions, but cannot act to limit them.

In March 2016, the City prepared a scheme amendment to remove those provisions of CPS2 that have now been superseded by the Deemed Provisions and to also make it clear which provisions of CPS2 are still relevant. Minor amendments were also made to the Town Planning Schemes No’s 11, 13, 14, 16, 21, 23, 24 and Local Planning Scheme No.26 in order to align with the Regulations. These amendments have been approved by the Minister for Planning and were published in the Government Gazette on 24 February 2017. The City has also prepared an amended Application Information Kit that includes the new Application for Development Approval in addition to the existing Application to Commence Development MRS Form 1. City Planning Scheme 2 

All land that the City of Perth is responsible for is subject to the City of Perth City Planning Scheme No 2. 

The City Planning Scheme 2 consists of the Scheme Text, the Deemed Provisions, the Supplemental Provisions contained in Schedule A to the Deemed Provisions, Scheme Map, Plot Ratio Plan, Building Heights Plan, and a number of plans relating to bonus plot ratio. 

The City Planning Scheme 2 provides for the creation of precinct plans and planning policies, which support and further guide decision making.

A number of minor town planning schemes also apply to development sites across the city.  These are complementary to City Planning Scheme 2.
