All local governments in Western Australia are required to maintain a Local Planning Scheme. The City of Subiaco gazetted Town Planning Scheme No. 4 in March 2001. Several amendments have been made since then.
The Deemed Provisions within the Planning and Development (Local Planning Schemes) Regulations 2015 will automatically apply to all Local Planning Schemes on 19 October 2015. A copy of the Regulations can be downloaded from this website or from the State Law Publisher at www.slp.wa.gov.au. The Deemed Provisions are to be read in conjunction with the Town Planning Scheme as many provisios replace or over-ride requirements of the Scheme, or add further provisions to the Scheme.
The town planning scheme text provides the statutory guidance for development including development provisions, permitted uses and compliance matters. This version of the Scheme has been annotated with notes to refer to sections that have been replaced by the Deemed Provisions, or where reference to the Deemed Provisions should be made.
The town planning scheme text which is accessible on the Western Australian Planning Commission website is also available for reference. This version of the scheme is not annotated with notes relating to the Deemed Provisions of the Planning and Development (Local Planning Schemes) Regulation 2015.
The town planning scheme map provides the zonings for the land, which indicate the type of uses that may be possible in each particular area.
To provide additional aspects of development control and guidance for the development of sites, the Town Planning Scheme No. 4 allows the council to adopt planning policies that guide both residential and non-residential development.
Planning policies are designed to ensure a high quality of development is maintained through consistent decision making and the processing of development applications in a fair and equitable manner
Planning policies should be read in conjunction with the town planning scheme and the Residential Design Codes (R-Codes). The R-Codes are state government document that sets the basic controls for residential development for the whole of Western Australia.
